Prop 90 – Government Acquisition, Regulation of Private Property. Initiative Constitutional Amendment
My Summary: This one is fairly complicated when you read the summary, but McClintock has a nice summary: "Prop. 90 prohibits local officials from seizing homes and businesses for the profit of politically well-connected private interests, and requires government to pay you for any damage it does to your property."
My Opinion: The government using eminent domain for vital infrastructure is necessary. Sometimes we need a freeway or fire department where a peron’s house sits. As long as that person is warned in advance and paid market value for their property I have no beef. From what I understand, this prop is righting a wrong, where currently people’s property can be claimed under eminent domain like circumstances for private development. This would be like having a house in an area where a city wanted to put a mall, and the city is within it’s power to force you out. Like I mentioned, it’s all a little confusing, but it’s related to this decision last summer.
Bottom Line: Sounds like government has too much power in being able to take a person’s home, church, or business and use it for private projects. This proposition will stop that and give back the power to homeowner’s.
I am voting YES on Prop 90.
